This agreement governs your use of Baby's Day In. We've written it to be honest and human — because you're sleep-deprived enough without dense legalese.

01 · Introduction & Service Definition

Welcome to Baby's Day In.
Here's how it works.

Baby's Day In (BDI) is a hardware-free, two-smartphone monitoring architecture designed to mitigate parental cognitive load and back up a mother's instinct with intelligent data. This Master Terms of Service and Privacy Policy ("Agreement") governs your use of the BDI mobile application and services.

By utilising BDI, you are establishing a secure, encrypted link between a Nursery Camera Phone (the secondary device) and a Primary Parent Phone (the monitoring device).

  • Live video transmission Real-time streaming from the nursery to your primary device, securely encrypted end-to-end.
  • Cry classification Intelligent audio processing that distinguishes between hunger, tiredness, and discomfort.
  • Auto-Soothe Automated audio triggers — lullabies, white noise, or your own voice — to settle your infant before an alert reaches you.
  • Activity logging & wellness analytics Feeds, changes, and growth compared against World Health Organization (WHO) standards.

02 · Medical Disclaimer & Liability

Honest about what
BDI is — and isn't.

Baby's Day In is a wellness and informational tracking tool, not a regulated Class II or Class III medical device. BDI is not intended to be "substantially equivalent" to any FDA-cleared clinical monitor under the 510(k) pathway. We do not claim to provide clinical accuracy for the diagnosis, cure, mitigation, treatment, or prevention of any disease or cardiorespiratory condition.

SIDS Notice — American Academy of Pediatrics

In accordance with the AAP, home cardiorespiratory monitors should not be used as a strategy to reduce the risk of Sudden Infant Death Syndrome (SIDS). BDI does not prevent, treat, or diagnose SIDS. There is currently no medical evidence that consumer physiologic monitors are life-saving.

Medical applications have a documented track record of inaccuracy — studies have shown blood pressure apps falsely reassuring 80% of hypertensive users. BDI is positioned strictly as a wellness tool. You acknowledge and accept that:

  • Healthy infants may experience innocuous physiological events which do not require clinical intervention.
  • Motion artefacts or environmental variables may trigger false-positive alarms.
  • BDI is not liable for "cascades of events" resulting from these alarms, including but not limited to unnecessary emergency department visits, blood tests, x-rays, or hospital admissions.
  • You assume all risk for clinical decisions made based on app notifications.

Wellness logs compared against WHO standards are for informational reference only. They demonstrate general population norms and must never replace the professional judgement of a paediatrician.

03 · Affirmative Express Consent

We believe you're the expert
on your own baby.

By activating the Service, you provide Affirmative Express Consent for the following:

  • Sensitive Health Logging You voluntarily attest to logging sensitive data, including medication, vaccine history, and temperature.
  • Audio/Video Processing You authorise the app to transmit live video and process audio for cry detection and Auto-Soothe triggers.
  • Safe-Sleep Practices You agree to maintain standard safe-sleep environments. Adhering to these safety protocols is the primary way you "earn your rest," allowing the app to serve as a secondary backup to your physical presence.
04 · Technical Safeguards & Security

Safety by Design.
NIST & PSTI mapped.

BDI utilises a "Safety by Design" architecture. We map our security characteristics to the NIST Cybersecurity Framework (v1.1) and the UK Product Security and Telecommunications Infrastructure (PSTI) Act to ensure hardware-rooted security.

05 · Privacy Policy

Zero tracking.
Full data sovereignty.

In alignment with our core brand values, BDI operates a zero-tracking environment. Your family's data stays within the BDI ecosystem.

  • No Third-Party SDKs We do not integrate SDKs from social media companies or third-party advertisers.
  • No Data Monetisation We never share, sell, or trade your family's data with data brokers.
  • Minimal retention Video and audio streams are processed in real-time only. Logged activity data is retained only for the duration of your active account and purged upon termination.

You possess full sovereignty over your data, including:

    Right to Erasure Permanent, immediate deletion of all parent and infant records.
06 · UK PSTI Act & Breach Notification

Compliant.
Transparent. Always.

In compliance with the UK PSTI Act and IMDRF guidelines, BDI maintains a Coordinated Vulnerability Disclosure (CVD) process. We invite stakeholders and security researchers to report vulnerabilities to our security team for remediation.

Health Breach Notification Rule

In the event of a breach of unsecured PHI (Protected Health Information), we warrant that we will notify affected users and the relevant regulatory authorities within the legally mandated timeframes.

07 · Software Lifecycle & Standards

Clinical-grade care for
your baby's data.

BDI is developed under rigorous international safety benchmarks for wellness software:

  • ISO 14971 — Risk Management We apply systematic risk management at every lifecycle stage, using Appendix C to determine the risk profile of every app feature.
  • IEC 62304 — Software Lifecycle Our software lifecycle processes govern the safe design and maintenance of our firmware and application code.
  • ISO 13485 — Design Control We ensure consistent design control and performance reliability, treating your baby's data with clinical-grade care.
08 · Termination & Account Deletion

Reduce the load.
Leave when you're ready.

We want to reduce your mental load, not add to it. If you decide BDI has fulfilled its purpose for your family, you may delete your account at any time via the app settings.

This action triggers the permanent, irreversible deletion of all baby logs and personal data from our systems. It is our way of helping you clear the "invisible load" — leaving you with one less thing to worry about as you move into the next stage of motherhood.

Immediate & complete

All logs, recordings, and reports are purged permanently. There is no retention window, no waiting period.
